Hello everyone,
On the 1st of February 2022 we're going to have a data transfer from Dynamight Studios to gamigo.

So do we need to Download Gylph Launcher now?

Yeah, as a very first step to instill confidence, a publisher, that has a seriously bad reputation with the gaming community, chooses to remove the protection granted by EU law and instead move the data and jurisdiction to the United States. If you don't want your rights to be be removed and your data to be sold, tough luck, no refunds for you.
But this move is certainly required to 'operate the game', because, yeah well... because!

I did read through both the complete ToS and the complete PP.
Including:
'(...)21.6 The Commission of the European Union provides an Internet platform for online dispute resolution(...)21.7 The Provider is not willing to participate in such an out-of-court settlement of disputes arising from contracts with our customers, not even under the VSBG (Consumer Dispute Settlement Act).'
Furthermore, the European Court decided in C-311/18, Schrems II that data transmission to the US can no longer be subject to the privacy shield.
Last, but not least, there's no way to access these '(...)EU standard contractual clauses/SCC(...)', so you'd have to go in with complete and blind trust that they are indeed covering complete European law and even if it did, the jurisdiction would be moved from European to US courts.
Thanks for asking me to clarify my statement, I should have been more specific right away.
Does this elaboration on my concerns help to understand my displeasure?

ugh.. yet another reminder of the stain that is Trion. I used to get excited when I saw Fractured news, lately it's just disappointing.

So can we refund if we not agree or do we just loose our big investment?
Is there any law in EU we can use for?

@Sweetdeal89 if you read through everything, they specifically state that refunds will not be made available if you decide not to do the data transfer.
Basically, you have your original window to ask for a refund from when you purchased, and that's it.

This is why I never pre-purchase, pre-order, buy founders packs or whatever else you want to call it. Gamigo / TrionWorlds / Glyph are infamously known for money grabbing hot garbage. No thanks. Such a shame really.

I did opt-out, am I eligible for a refund?
No, not gamigo nor Dynamight Studios will offer refunds for game packages, store purchases, or game access if you opt-out.Someone sue these fools.

Seem thanks to EU law I can refund anytime, I prob. Going to use that. Very sorry for the guy, but he should have talked with his Community, before he's going to make this bad step.

the whole reason i followed your game and had hopes for it was that you where independent of companies like gamigo which are known for face planting good projects into the ground with horrible business decisions. Im out now... later...
