Thief flags

From what I understand if you loot a body you get flagged as such for 24 hours. But does this flag occur as soon as you look at the items you can take or when you actually take an item. Basically if say I go to loot a body but don't see anything I want and thus don't take anything, will I still get flagged? Or do I have to take something first?

Keeping stuff on while in a store is legal. I’d like the option to browse before taking.

I think when you take, because looking can happen accidentely I think in point and click games. If they would place and extra step between it, looting will be too annoying I think in mass pvp.
Best option would be if there where lots of settings for looting. From turning looting off to prevent beatman to get accidently exiled or something, till autoloot for demons that want to rely on pvp income only. And several options in between.
